How It Works: The Probate & Estate Administration Process
Losing a loved one is incredibly difficult, and navigating the legal aftermath shouldn’t make it harder. At Andy Gregory Law, we believe estate administration should be about compassion, clarity, and peace of mind. We take the legal burden off your shoulders so you can focus on your family. Here is how we navigate the Minnesota probate process together.
1. The Compassionate Consultation
Our goal: Listen to your story, review the documents, and lift the weight.
First, we sit down together (at one of our three office locations or virtually) for an informal, no obligation meeting.
- What we do: We review your loved one’s Will (if they had one), discuss their assets, and determine if probate is actually necessary (sometimes we can avoid it entirely!).
- Your takeaway: You leave this meeting with a clear roadmap, an honest estimate of timelines and costs, and the relief of knowing you don’t have to carry this alone.
2. Opening the Estate & Court Filings
Our goal: Handle the heavy legal lifting and get you officially appointed.
If probate is required, we begin preparing the formal court documents to petition the court.
- What we do: We draft and file the petitions to have the court formally appoint the Personal Representative (sometimes called an Executor). We also handle the legally required public notices and mailings.
- Your takeaway: You don’t have to step foot in a courtroom or worry about filling out confusing government forms. We manage the entire court interface for you.
3. Gathering & Safeguarding Assets
Our goal: Create an organized inventory of the estate.
Once you are officially appointed as the Personal Representative, we help you round up and secure the assets of the estate.
- What we do: We work alongside you to identify bank accounts, real estate, investments, and personal belongings. We help you publish notices to creditors and manage the four-month statutory creditor period.
- Your takeaway: We provide you with simple checklists and organization tools to make sure we don’t miss a thing, keeping you legally protected every step of the way.
4. Wrapping Up Taxes, Debts, & Accounting
Our goal: Clear the slate and prepare for distribution.
Before any assets can be handed down to the heirs, we must ensure all of the decedent’s final affairs are wrapped up.
- What we do: We help resolve any legitimate creditor claims, coordinate with your CPA on final tax returns, and draft a clear, transparent “Final Accounting” that shows the beneficiaries exactly how the estate was managed.
- Your takeaway: Total transparency. We ensure your accounting is completely bulletproof, protecting you from future misunderstandings or family disagreements.
5. Smooth Distribution & Closing the Estate
Our goal: Safely deliver the inheritance and close the book.
With the courts satisfied and the bills paid, it is finally time to distribute the remaining assets to the beneficiaries.
- What we do: We prepare the deeds, transfer documents, and receipts to safely distribute the assets exactly as your loved one intended. Once complete, we file the final closing documents with the court.
- Your takeaway: Closure. The estate is legally and cleanly finalized, your loved one’s legacy is secured, and your duties as Personal Representative are officially complete.
