What Is Formal Probate?
Formal probate involves court proceedings in the Minnesota District Court, which may be conducted on a supervised or unsupervised basis, depending on court orders and the needs of the estate.
Unlike informal probate – where a probate registrar administratively appoints a Personal Representative without a formal hearing – formal probate requires court petitions, judicial hearings and formal court orders.
When Is Formal Probate Required?
Formal probate in Minnesota is typically filed in cases where there is no agreement about heirship (in an intestate estate), where a will is contested or unclear, or where the estate has complex assets and liabilities and a party requests formal probate through a petition:
- Dying without a valid Will (dying intestate) with disputes as to the heirship
- The terms of the Will are ambiguous, complex or contested by interested parties.
- The estate involves significant, complex assets or substantial outstanding debts.
- A minor or incapacitated person is designated as a primary beneficiary.
- A judge must appoint a personal representative to supervise estate distribution.
The initial steps of the probate procedure start after someone files a petition with the probate court. The court then conducts a hearing at which a Personal Representative is appointed and the Will, if any, is proved. Then, an inventory is taken, creditors are notified, and legitimate debts and taxes are paid; eventually, the remainder of the Will is distributed under court direction.
